Man arrested on eight counts of sex abuse

by: MARION COUNTY JAIL  - Francisco San Juan-JoseA Gervais man is in custody after admitting to sexually abusing his niece over an approximately one-year period in the late 1990s.

Francisco San Juan-Jose, 52, was arrested Oct. 23 by the Gervais Police Department for alleged crimes that included sexually touching and kissing his niece, who was 9 or 10 years old at the time.

The victim, now 27, reported allegations last month that her uncle had sexually abused her “nearly every day” when she was 11 years old or younger.

During the interview with Gervais Police Department, San Juan-Jose admitted to touching his niece inappropriately while living on the 300 block of Cedar Avenue in Gervais, according to a probable cause statement released by Marion County Jail. He also admitted to having his niece sexually touch him over his clothes at least once.

San Juan-Jose was arrested and charged with eight counts of first degree sex abuse. Sex abuse 1 is a Measure 11 crime with each count punishable by a mandatory minimum sentence of six years, three months. He is lodged at Marion County Jail.

Peter Spirup, chief of Gervais Police Department, told Gervais City Council Thursday that his department has been working on the case exhaustively since the victim came forward.

He could not comment further on the case because it is still under investigation, he said.

Juan-Jose’s next court appearance is scheduled for Wednesday at 8:30 a.m. His initial bail has been set at $500,000.
